Foreign workers may be entitled to more severance than other employees

In Nishina v. Azuma Foods (Canada) Co. Ltd., the British Columbia Supreme Court suggested the standard severance rules may need to be somewhat more flexible to address the needs of foreign workers. In this case, a major factor that contributed to the larger severance given to the foreign employee was the fact her employment contract restricted her to working with the defendant employer.

Minimum wage increases for 2011

A number of jurisdictions have ­announced minimum wage increases in 2011. Here’s a quick review:

Nunavut: Increases to $11 per hour from $10 per hour on Jan. 1.

Northwest Territories: Increases to $10 per hour on April 1.

Quebec: On May 1, the minimum wage goes up from $9.50 per hour to $9.65. In addition, beginning May 1, 2014, the general minimum wage rate will apply to all agricultural workers. The minimum wage rate for employees who receive gratuities or tips will increase from $8.25 per hour to $8.35.

New Brunswick: The minimum wage will rise from $9 to $9.50 per hour on April 1 and to $10 per hour on Sept. 1.

Manitoba will pay tuition for doctors to stay in province

Manitoba has announced medical students who agree to work for the province’s underserved populations after graduation will have their tuition fees reimbursed. Starting in fall 2011, students will be able to receive grants of $12,000 for each of their first three years of medical school in exchange for six months of service to designated populations. In their fourth year, students will have access to a $25,000 grant by committing to an additional one-year return of service.
