Drummer files wrongful dismissal suit

Former member of Breaking Benjamin alleges the band unfairly kicked him out

The former drummer of American rock band Breaking Benjamin is suing his former band mates, claiming he was wrongfully kicked out while on paternity leave.

According to court documents, Jeremy Hummel’s band mates — Benjamin Burnley, Aaron Fincke and Mark Klepaski — agreed that he could take a four to six-week leave to be with his wife for the birth of their first child.

Then in September 2004, Burnley called Hummel, who was still on paternity leave, and told him he was dropped from the band.
