Alberta considers penalty system for OHS infractions
Edmonton — Alberta is considering establishing an Administrative Penalty System (APS) for occupational health and safety infractions. A draft of the proposal has been developed by the OHS Policy and Program Development Branch of Alberta Human Services, in collaboration with the OHS Council, and has been submitted to the Minister of Human Services for his consideration. The APS would allow monetary penalties to be levied by OHS officers without the need for judicial action and would allow a penalty to be applied when there is a creation of a risk of harm or any non-compliance. Whether a penalty would be issued and the amount of the penalty would be based on an OHS officer’s observations and a consideration of information regarding a worksite.
