Company directors fined for not paying wages

Ministry of Labour investigates claim of 121 unpaid hours


Two directors of Aadvanced Merchandising, of Oakville, Ont., were convicted and fined $3,000 each in the Ontario Court of Justice for failing to comply with a Ministry of Labour order to pay wages owed to a worker.

The conviction came after the ministry investigated a claim by an employee of Aadvanced Merchandising for 121 hours of unpaid wages in September 2004. The ministry issued an order to pay $1,661.82, including a $151 administration fee.

The two directors failed to comply with the order. Emile Bakker and Gerald W. Kinasz were found guilty of committing the offence against the Employment Standards Act. In addition to the fine, the court imposed a 25-per-cent victim fine surcharge on the total, as required by the Provincial Offences Act. The surcharge is credited to a special provincial government fund to assist victims of crime.
