P.E.I. Workers Compensation Board looks for feedback on amended new evidence policy

Policy amended to clarify when new evidence will be considered by the board

The Workers Compensation Board of Prince Edward Island has approved changes to its new evidence policy in principle and is now looking for feedback.

The changes clarify how and when new evidence will be considered by the board to change or reverse a decision on a claim.

The policy specifies that a request made to reverse or change a decision must be made in writing if it is requested one year or more after the date of the decision.

The policy maintains the previous definition of what constitutes new evidence. It outlines situations where information is not considered new evidence.

It states that evidence is not considered new if it summarizes, reformats, reiterates or reviews information that is already on file, consists of an opinion which is based on evidence or findings that is already on file or substantially similar evidence or findings or of legal argument or re-argument.

The board will be accepting feedback on the draft policy until August 7. The policy is available for review at: http://www.wcb.pe.ca/DocumentManagement/Document/pol83_draft.pdf.
